Terms and Conditions
1. Introduction
Welcome to Stamp Duty Refunds ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website and services provided to help clients claim Stamp Duty Land Tax (SDLT) refunds ("Services"). By accessing or using our website and Services, you agree to comply with and be bound by these Terms.
2. Eligibility
By using our Services, you confirm that:
You are at least 18 years old.
You have the legal authority to enter into a binding agreement.
You have sought and obtained permission from all parties with an interest in the property for which the SDLT refund is being claimed.
3. Services Provided
We assist clients in claiming SDLT refunds from HM Revenue and Customs (HMRC). We provide guidance, submit claims on your behalf, and manage the communication with HMRC during the claim process.
4. Fees
In the event of a successful claim, we will charge a fee equal to 30% of the refund amount to cover our overheads. This fee will be deducted from the refund before it is transferred to you. No fees are charged if the claim is unsuccessful.
5. Client Responsibilities
By submitting a claim through our Services, you agree to:
Provide accurate and truthful information regarding your property and SDLT payment.
Ensure that all necessary permissions have been obtained from all interested parties in the property.
Acknowledge that you are responsible for any false or misleading information provided.
6. Refund Policy
If it is discovered that false or misleading information was provided in relation to your SDLT claim, you will be required to refund any fees received from the claim. Additionally, HMRC has the right to request the refund back if a fraudulent claim is identified. You agree to indemnify us against any losses, costs, or damages incurred due to fraudulent or false claims.
7. HMRC Review Period
By law, HMRC has a set period from the date the claim was made to conduct a detailed check to ensure the validity of the claim. If HMRC determines that the claim was fraudulent or invalid, they have the authority to request the refund amount to be repaid.
8. Limitation of Liability
We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Services. Our total liability to you for any claim arising from the use of our Services shall not exceed the amount of fees received by us for the successful claim.
9. Termination
We reserve the right to terminate or suspend your access to our Services at any time, without prior notice, if you breach these Terms or for any other reason at our sole discretion.
10. Amendments to Terms
We may update these Terms from time to time. Any changes will be posted on our website, and your continued use of our Services after such changes have been posted constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
